SAFETY, LIABILITY & RISK DISCLOSURE

PLEASE READ CAREFULLY. USE OF THIS PRODUCT CONSTITUTES ACCEPTANCE OF THESE TERMS.

1. ASSUMPTION OF RISK (HIGH-RISK SPORT)

Kitesurfing is an inherently dangerous activity. By purchasing or using @the.line.smith products, you acknowledge that you are engaging in a high-risk sport that involves the risk of property damage, serious physical injury, paralysis, and death. You voluntarily assume all risks, known and unknown, associated with the use of this equipment.

2. TOTAL EXCLUSION OF LIABILITY

To the maximum extent permitted by law, The Line Smith, its directors, and employees shall not be liable for any damages (direct, indirect, or consequential) arising from:

• Inherent Risks: Any accident occurring during the normal or extreme pursuit of kitesurfing.

• Third-Party Damage: Injury to bystanders or damage to others' property (vessels, kites, or gear).

• Environmental Factors: Failure due to UV degradation, salt-water corrosion, or heat exposure (above 60°C).

• Mechanical Influence: Lines cut or weakened by reef, shells, sand, or friction with other kite lines.

3. MANDATORY INSPECTION & MAINTENANCE

Kitesurfing lines are consumable technical components. Their lifespan depends entirely on user care.

• The 50% Rule: Any knot in a line reduces its breaking strength by approximately 50%. Never fly with knotted lines.

• Pre-Flight Requirement: The user must inspect all lines and pigtails for frays, nicks, or core exposure before every session.

• Replacement Cycle: Lines must be replaced every 100 hours of flight or once per year, whichever comes first. Failure to do so constitutes user negligence.

4. USAGE & COMPATIBILITY LIMITATIONS

Liability is strictly excluded in the following scenarios:

• Hardware Incompatibility: Damage caused by worn/sharp bar eyelets or incorrect safety-system routing.

• Professional/Extreme Use: Failures occurring during competitions, professional stunts (e.g., Megaloops), or commercial school use.

• Modifications: Any DIY splicing, shortening, or chemical treatment (dyes/coatings) voids all warranties and releases the manufacturer from all liability.

• Incorrect Setup: Failures resulting from improper larks-head knots or user-tied knots at the kite/bar connection points.

5. INDEMNIFICATION & LEGAL VENUE

The user agrees to indemnify and hold The Line Smith harmless from any third-party claims or legal fees resulting from the user's operation of this equipment. Any legal disputes shall be governed by the laws of the jurisdiction where the manufacturer is registered.

6. SEVERABILITY

If any part of this agreement is deemed unenforceable by a court, all other parts remain in full effect. The Line Smith reserves the right to update these safety terms at any time.

7. EXCLUSION OF THIRD-PARTY CLAIMS

The user is solely responsible for the safe operation of their kite and lines. The Line Smith shall not be held liable for any damage caused by the user to third parties, including but not limited to:

• Injury to bystanders or other water users.

• Damage to property, vessels, or other kitesurfing equipment.

• Damage caused by "lost" or "runaway" kites resulting from line or safety system failure. It is the user's responsibility to maintain adequate third-party liability insurance.
  
  

8. EXCLUSION FOR PROFESSIONAL & EXTREME USE

Our products are designed for recreational kitesurfing. Liability is strictly excluded for failures occurring during:

• Professional Competition: High-stress maneuvers (e.g., Megaloops, Big Air) exceeding standard load profiles.

• Commercial/School Use: Rental or school environments where equipment is subject to accelerated fatigue.

• Extreme Weather: Use in wind speeds or conditions exceeding the kite manufacturer’s recommended limits.

9. EXCLUSION OF "INCIDENTAL" ACCIDENTS

Liability is explicitly excluded for line failure caused by external mechanical influence, such as:

• Line-on-Line Friction: Damage caused by crossing lines with another kiter.

• Self-Landing/Launching: Abrasion caused by dragging lines over sand, shells, rocks, or pavement.

• Animal/Marine Life: Damage caused by contact with reef, sea life, or sharp objects in the water.

10. SYSTEM COMPATIBILITY DISCLAIMER

The Line Smith manufactures lines, not full control systems. We exclude all liability for failures caused by:

• Abrasive Bar Eyelets: Use of our lines with control bars that have sharp, worn, or unpolished center holes.

• Incorrect Pigtail Connection: Improper larks-head knots or "bowline" knots tied by the user.

• Safety System Interference: Lines that are too thick or too thin for the specific safety/flag-out system of the user's brand of bar.

11. STORAGE & CHEMICAL EXPOSURE

Synthetic fibers (Dyneema/Spectra) are sensitive to heat and chemicals. Liability is excluded if the lines have been:

• Stored in a vehicle or container exceeding 60°C.

• Exposed to aerosol sprays, insect repellents, sunscreens, or harsh cleaning detergents.

• Stored while damp, leading to mold or salt-crystal degradation of the fiber core.
